General Terms and Conditions
This translation is provided for convenience. The German version is legally binding.
§ 1 Scope and provider
These General Terms and Conditions apply to all orders placed in the online shop scaleeditions.de. Your contractual partner is HENQ Technologies GbR, St. Johannes Straße 16, 59964 Medebach, email: info@henq-technologies.com, phone: +49 176 66650703.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). Deviating terms of the customer do not apply, even if we do not expressly object to them.
§ 2 Conclusion of contract
The presentation of products in the shop is not a legally binding offer but an invitation to order. You place motifs in your cart and go via “Checkout” to the payment page of our payment provider Stripe. There you enter your contact, delivery and payment details and see all items, the total price and the shipping costs once more before submitting. Until then you can correct your entries at any time or cancel; to change the cart, return to the shop.
By clicking the “Buy” button you submit a binding offer to purchase the goods in your cart. The purchase contract is concluded once the payment has been successfully initiated. Immediately afterwards you receive an order confirmation by email.
§ 3 Language and contract text
The language of the contract is German. We do not store the contract text in a way that lets you retrieve it from us after conclusion. You receive the order details by email; these terms and the withdrawal notice can be viewed, printed or saved on this website at any time. You also receive both in text form with the delivery at the latest.
§ 4 Prices and shipping costs
All prices are final prices. They include statutory VAT. Shipping costs of €7.50 per order without frame, €8.50 with frame are added. They are shown in the cart and on the payment page.
§ 5 Delivery
We deliver to addresses in Germany only, with DHL and with tracking. Goods are ready to ship within 1–2 working days of receipt of payment; DHL usually takes another 1–2 working days. If a motif is exceptionally unavailable, we will inform you without delay and refund any payments already made.
§ 6 Payment
Payment is made on ordering via Stripe. The payment methods shown on the payment page are available, for example credit card, PayPal, Apple Pay or Google Pay. The purchase price is due on conclusion of the contract.
§ 7 Retention of title
The goods remain our property until paid in full.
§ 8 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal notice.
§ 9 Liability for defects
Statutory warranty rights apply. Every motif is lasered individually; slight differences in line pattern and paper texture between two copies are part of how they are made. If a parcel arrives damaged, please report it to the carrier straight away if possible and let us know. Your statutory rights do not depend on this, but it helps us to assert claims against DHL.
§ 10 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In the case of slight negligence we are only liable for breach of an essential contractual obligation, the fulfilment of which makes proper performance of the contract possible in the first place and on whose observance you may regularly rely, limited to the typical, foreseeable damage.
§ 11 Dispute resolution and final provisions
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.
